The Appeal Policy of the Accreditation of Medical Education, Ministry of Education

The Working Committee for the Accreditation of Medical Education, Ministry of Education (WCAME) conducts accreditation of medical education programs in medical schools according to the Standards for Basic Medical Education and Guidelines for the Accreditation of Basic Medical Education.This appeal policy is formulated, in order to protect the right of the accredited institutions to exercise their appeals, and to maintain the openness and fairness of the results of accreditation.

I  Appeal Agency

i The Secretariat of the Working Committee for the Accreditation of Medical Education of the Ministry of Education (hereinafter referred to as the Secretariat) is responsible for the collection, transmission and archiving of appeals.

ii The Expert Committee for Medical Education of the Ministry of Education (ECME) is responsible for accepting complaints, forming an arbitration group to suggest for arbitration decisions.

Iii The arbitration group is responsible for conducting investigations and deliberations and giving decision proposal on appeals.

The members of the arbitration group are composed of five members of the ECME (one leader, four members) and one secretary. The arbitration group shall be chaired by the director or deputy director of the ECME in principle. Members of the arbitration group shall follow the principle of avoidance of conflicts of interest: a)Not a beneficiary of the appealing party; b). Not a WCAME member.

II The Subject and Scope of Appeal

i The accredited school is dissatisfied with the WCAME’s accreditation decision;

ii The accredited school is dissatisfied with the withdrawal of WCAME’s accreditation status.

III The appeal Procedures

The accredited school submits a written appeal to the Secretariat, and the Secretariat submits the appeal materials to the ECME. The ECME agrees to an arbitration group after acceptance. The arbitration group will submit the decision proposal to the ECME, and the arbitration result of the ECME is the final appeal decision.

i Submit the appeal

1. The accreditation decision shall be published on the official website of WCAME. If the accredited school is dissatisfied with the accreditation decision, it must submit a written appeal to the Secretariat within 10 working days of the publicity period. The materials include the appeal and relevant materials supporting the reasons for the appeal. If the accredited school fails to submit a written appeal within 10 working days of the publicity period, the accreditation decision made by the WCAME will be regarded as the final decision.

2. The announcement of the decision to revoke the accreditation decision shall be published on the official website of WCAME. If the accredited school is dissatisfied with the decision to revoke the accreditation decision status, it shall submit a written appeal to the Secretariat within 10 working days of the publication period. The materials include the appeal and relevant materials that can support the reasons for the appeal. If the accredited school fails to submit a written appeal within 10 working days of the publicity period, the decision of WCAME to withdraw the accreditation decision will be considered final.

ii Accept the appeal

1. The ECME reviews the appeal materials submitted by the Secretariat and decides whether to accept or reject the appeal of the accredited school. If the appeal is accepted, the ECME shall form and authorize the arbitration group. The group shall conduct investigations and deliberations and give decision proposal on appeals of the accredited school through material interviews and field visits.

2. Before the appeal is reviewed, if the appeal party requests to withdraw the appeal, the appeal may be withdrawn after explanation of the reasons. However, after withdrawing the appeal, the appeal party may not file an appeal again on the same fact and reason.

iii Review and decision of the appeal

1. The arbitration group will conduct a review through a hearing and give a decision proposal. Hearing attendance includes:

(a) If the accredited school is dissatisfied with the accreditation decisions made by the WCAME, the hearing attendance includes: the arbitration panel, the representatives of the accredited school (no more than 3), the representatives of the assessment team (no more than 3) and the representatives of the WCAME (no more than 3).

(b) If the accredited school is dissatisfied with the decision of WCAME to revoke the accreditation decision status, the hearing attendance includes: the arbitration group, the representative of the accredited school (no more than 3), and the representative of the WCAME (no more than 3).

A legal counsel can be invited through the Secretariat if necessary.

2. The arbitration panel shall complete the investigation and hearing within 30 working days after the authorization of the ECME, and make a decision proposal. The arbitration group will submit the decision proposal to the ECME, and the arbitration result of the ECME is the final appeal decision. The ECME may arbitrate in the form of on-site work meetings or emails.

3. The appeal decision includes: (a) Maintaining the original accreditation decision; (b) Changing the original accreditation decision. The appeal decision is published by the Secretariat on the official website of WCAME, and the appeal party and the WCAME are notified in written form.
